On President Obama & Honduras

Sadly the Obama Administration has joined Castro and Chavez in attacking Honduran Supreme Court and Congress for defending their Constitution.

Having Fidel Castro call for defending democracy should convince any reasonable person that Honduras was on the edge of a leftish dictatorship.

Congresswoman Ileana Ros-Lehtinen expressed her opinion on the matter by saying “Honduras: President overstepped in his power grab by going against constitution”.

I applaud Jim DeMint's efforts as his view best crystalizes the issue. He has done his home work on this issue, and found outright ineptitude as the only basis to explain US Policy.

Currently the US Policy assumes as fact that a Military coup or something similar occurred in any case representing an interuption of constitutional order and normalcy in Honduras. As such the US has joined international efforts determined to reinstate Manuel Zelaya as president, and has refused to recognize the new President and have cut off substantial amounts of aid to one of the poorest countries in latin america.

We now know that the Honduran Supreme Court sustained charges of both a constitutional nature and within the penal code. They also aproved a warrant for his arrest to restore constitutional order. The charges were brought by the Honduran Attorney General (an independant constitutional office). Once completed, the court and the Attorney General summoned the head of the armed forces to carry out the arrest, which they did. As we all know the Armed forces then sent Zelaya to Costa Rica instead of bringing him before the court for arraignment.

Later the same day, the National legislature voted with a 95% plurality to separate Zelaya from his duties as President, and then appointed Roberto Micheletti to President since he was next in line. The Honduran high court made a finding that the succession of Presidents was appropriately constitutional.

Yet you will not find the slightest acknowledgement from US State Department spokesmen, never mind policy makers that the legislative and judicial branches of government were "behind" the succesion. All they have ever done is blather on about the Military intervention as if it was the be all and end all to the subject.

This leaves some serious questions that the Obama Administration policy makers MUST be brought to task on.

1) The Honduran Constitution provides the Supreme Court the authority as final arbiter in all matters of law and interpretation. They made findings that Zelaya was knowingly and with full deliberation engaged in unlawful and unconstitutional acts. They also made findings that the succession of Presidents was constitutional. So what gives the US and OAS the right to over turn the Honduran right to self determination, and the right and authority of the Honduran high court to interpret their own constitution.

2) The will of the Honduran people was expressed through their duly elected representatives when the voted to relieve Zelaya of his duties as president (fired him) and voted to appoint the next line line as President. This was stated as for cause pertaining to Zelaya's unconstitutional and unlawful acts and his stated intentions not to comply to the legal findings of the courts in regard to his referendum.

They have not made a single argument with a legal basis to justify the policy and why it is appropriate to interfer with the Honduran efforts to decide their own leadership.

Is it arrogance, ineptitude, incompetance? WHo knows, but clearly they did not make a full assessment of the facts before policy was formed, and then when news that the succession was in fact at least arguably a constitutional process they proceeded to dismiss, ignore, and deny the reality that they got it wrong..

It os high time for a complete Policy reversaql, recognition of the interum Honduran government as lawful and constitutional, restoration of ALL aid, and then do everthing to shut down the OAS and ALBA efforts to reinstate Zelaya. If he comes to the US he should be taken into custody and extradited to Honduras.

Why don't the Republicans call Obama on this issue with Honduras? Maybe members of Congress can come up with a petition or something in support of the real democratic forces in Honduras -- the legislature, the judiciary and the army that stood up to the Zelaya's attemped power grab. Unless I'm missing something, it seems like an obvious issue to blast Obama on. Republicans need to find a message. They need a unified voice and maybe defending democratic principles and rejecting the ALBA "democratic" alternative is a good place to start. Obama has been bold -- unfortunately his ideas are obviously terrible. He seems to leave a opening for the right, speaking in unison, to communicate their disapproval much more forcefully. Republicans really have an obligation to provide an alternative message that is clear and unified enough that citizens hear them.

RUsh Limbuagh has postulated that there could be a move on our own 22nd Amendment in the future should Obama last 2 terms. It is speculation of far in the future, but knowing these people, it is something we should be prepared for. I have also decided to lend my moral suppoert to the People of Honduras and their Congress, Supreme Court, and Military. I does seem like they were acting within the bounds of their written constitution, and the President was the one trying to bend it. I think we now have come to appreciate the value of conforming to a written Constitution, and the misery caused when those governing go outside its bounds.
