Does a terrorist’s right to free speech trump your right to life? I’m Newt Gingrich, more in a moment.

Before we lose a city in a terrorist attack – or, if we’re really stupid, after we lose a city – we’re going to have to have a serious debate about the First Amendment, what it protects and what it should not protect.

After all, the Constitution does not guarantee all speech. Lewd and libelous speech is not shielded by the First Amendment. So should speech that calls for the murder of Americans be protected?

Today, for example, there are websites dedicated to training and recruiting terrorists. They may be created overseas, but they are open and accessible to anyone with a computer.

America is engaged in a serious, long-term war with people committed to killing us. We need to be proactive – to act now – to develop the appropriate rules of engagement for dealing with websites and other forms of speech that advocate terrorism and the killing of innocent Americans.

We don’t need to amend or change our Constitution. We just need to decide that advocacy of terrorism, violence, and the killing of innocents brings no value to the American marketplace of ideas. It should be illegal and prosecuted aggressively.

Activist judges should not allow the First Amendment to be used to protect murderers. After all, we have inalienable rights of our own.
